Land Ownership in Kenya







Kenya has been abiding to a constitution since 1962.This constitution is out dated but is still active today. Some Kenyans wants to make a new constitution because times have changed and we can not keep using the old constitution. In the constitution proposed many problems are rising such as: Classification of land
61. All land in Kenya belongs to the people of Kenya collectively as a nation, as communities and as individuals.
In Kenya, land owned by someone who wasn’t born in Kenya or who isn’t a Kenyan cannot own land for more than a certain period of time 99years, this is a problem because for example people who own land and aren’t Kenyan may have land that they do business on and may want to leave it for their future generation but they can’t because the land is not permanently theirs. An example is like the owner of Delmonte has a piece of land that he uses to grow their fruits that they use to produce juices, but they can’t leave the business to their next generation because it isn’t entirely theirs. This is a disadvantage to the owner of the land just because he isn’t a Kenyan.
Problems that may arise because of this are like:
They will be court cases, people will be fighting for land, deaths will be caused etc.
To avoid any of these problems we should make a new constitution.

Comparing two countries.
Comparing Kenya to a country like the U.S it is very different because after six months of living in the U.S you become a citizen of the country and that means that you can own any land there and it can’t be taken from you. Unlike in Kenya where by if you’re not a citizen of Kenya you can’t own land for a long period of time.

I found a video of a Kenyan family complaining about the government chasing them out of their property. They did not understand why, they said that the government said that it wasn’t their land but the governments land. This was thousands of acres and the father was a farmer. It was harvest season, but because of the government taking them away. The did not manage to harvest anything. Date: September 18th 2009.

I interviewed two people who are not Kenyan but own land in Kenya. This was my mother and my uncle.
My mother said that she feels angry and unfair because she wants to build apartments in Mombasa but if the land is not hers, then she can never be too sure if the government comes and takes away everything

My uncle is a farmer who has a huge farm. He plants wheat. He lives in Rift Valley. My grandfather gave him the land to preserve and run. He wants to extend this by buying more land. Since the draft constitution says that the land cannot belong to him for ever and he is upset and thinks the law should be revisited.


personal opinion.
according to me i think that a new constitution should be made because the one that is active at the moment is too old, times have changed in the same way that the constitution should be changed.

  15. Nice Blog. However, The link to the blog states that it is about the Kenyan Land. However, The blog is about ownership of Kenyan Land. I think you should work abit on that. Also, you shold have based you information depending on your target audience. Was this sight meant for children or adults? If it was for children you should have used frank language that children understand. You might also want to consider the fact that not many children would be interested in land ownership. Anyways, nice layout, The video was really informative and the introductory piece on the Land ownership and the Kenyan Constitution is excellent. The Comparism between Kenya and The US was also quite enlightning. However, as mention before, It was a Comparison of land ownership in the two countries and not of the actual environmetal land. The blog is very good and informative, it is quite obvious that you took a lot of time to do this and you put in a lot of effort. Job Well Done!!




    Btw...you could have added a few more pictures on the Kenyan Land.
